Overview
Welcome to OralBrite! In these terms, “we”, “us” and “our” refer to OralBrite. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify.

These Terms of Service (“Terms”), together with the policies they refer to, describe your rights and responsibilities when you use the Services. Please read them carefully. By visiting, interacting with or using the Services, you agree to these Terms and to our Privacy Policy [link]. If you do not agree, please do not use the Services.

Section 1: Access and Account
By agreeing to these Terms, you confirm that you are of legal age in your country of residence, or that you have your parent’s or guardian’s permission. To browse or buy, you may be asked to provide information such as your email address and your billing, payment and shipping details. You confirm that everything you provide is correct, current and complete, and that you are allowed to provide it.

You are responsible for keeping your account details secure and for all activity on your account. You may not transfer, sell or share your account with anyone else.

Section 2: Our Products
We do our best to describe and show our products accurately. Colours and appearance can differ on your screen depending on your device and settings. We cannot guarantee that a product will look or perform exactly as shown in our store, and individual results can vary.

Product descriptions can change at any time without notice. We may discontinue a product at any time and may limit quantities per person, region or order.

Section 3: Orders
When you place an order, you make an offer to buy. We may accept or decline an order. An order is only accepted once we confirm it and have received your payment. Please check your order carefully before you submit it, as we may not be able to cancel it afterwards. If we do not accept, change or cancel an order, we will try to contact you using the email, address or phone number you gave us.

Returns and refunds are governed by our Return and Refund Policy [link]. You confirm that you are buying for personal or household use and not for resale or export.

Section 4: Prices and Billing
Prices, discounts and promotions can change without notice. The price you pay is the price at the time you place your order, shown in your order confirmation email. Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs or events outside our control. Please see our Shipping Policy [link] for details. Nothing in this section limits your statutory rights as a consumer.

Section 6: Intellectual Property
Everything in our Services, including the OralBrite name, logo, text, images, graphics, video, audio and the design and layout, belongs to OralBrite or its licensors and is protected by copyright, trademark and other intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not copy, distribute, modify, republish, download, store or transmit any of our material without our written permission. You may not use our name, logo or slogans without our written permission. Other names and logos in the Services belong to their respective owners.

Section 7: Optional Tools
We may give you access to tools from third parties, which we do not monitor or control. These tools are offered “as is” and “as available”. Using them is at your own risk, and you should read the terms of the provider. We may add new features in the future, and they are also covered by these Terms.

Section 8: Third-Party Links
The Services may contain links to websites run by others. We do not check or control their content or accuracy. If you visit them, you do so at your own risk. Please read the policies of those sites, and direct questions about their products to them.

Section 9: Relationship with Shopify
Our store is powered by Shopify, but you buy directly from OralBrite. Shopify is not responsible for any sale between you and us, including any injury, damage or loss from purchased products.

Section 10: Privacy
Personal information we collect is covered by our Privacy Policy [link]. Because our store is hosted by Shopify, Shopify also processes personal information, and some of it may be shared with other service providers, possibly in other countries. See the Privacy Policy for details.

Section 11: Feedback and Reviews
If you send us ideas, suggestions, reviews or other content (“Feedback”), you give us a free, worldwide, perpetual licence to use, reproduce, edit, publish and display it for any purpose, including marketing. You confirm that the Feedback is yours or that you have the rights to it, that you have told us about any reward or compensation you received for it, and that it is not unlawful, offensive or misleading. You may not use a false email address or pretend to be someone else. We may remove Feedback that breaks the law or these Terms, and we are not responsible for Feedback posted by you or others.

Section 12: Errors and Inaccuracies
Our Services may sometimes contain typing errors or inaccuracies, for example in descriptions, prices, promotions, shipping costs or availability. We may correct these at any time and may cancel orders affected by an error, including after you have placed an order. If we cancel an order you have already paid for, you will be refunded in full.

Section 13: Prohibited Uses
You may only use the Services for lawful purposes. You may not use them to:

• break the law, or infringe our rights or the rights of others
• harass, abuse, threaten or defame anyone
• send false or misleading information, spam or advertising
• pretend to be someone else
• upload viruses or malicious code
• copy, resell or exploit any part of the Services
• scrape, crawl, spam, phish or collect other people’s personal data
• bypass or interfere with security features

We may suspend or end your access if we believe you have broken these rules.

Section 14: Termination
We may end this agreement or your access to the Services at any time. You remain responsible for any amounts you owe up to that date. Sections that by their nature should continue after termination (such as Intellectual Property, Feedback, Liability, Governing Law and Privacy) will continue to apply.

Section 15: Disclaimer
Information in the Services is for general information only, and we do not guarantee that it is accurate, complete or useful. OralBrite is a cosmetic mouthwash and is not a medical product. It does not replace advice from your dentist. If you have specific dental concerns, please check with your dentist first.

To the extent permitted by law, the Services and products are provided “as is” and “as available”. We do not promise that the Services will be uninterrupted or error-free. This does not affect any rights you have by law as a consumer.

Section 16: Limitation of Liability
To the fullest extent permitted by law, OralBrite, its partners, staff, contractors and service providers (and Shopify and its affiliates) are not liable for indirect, incidental or consequential damages, or for lost profits, revenue or data, arising from your use of the Services or our products. Nothing in these Terms limits our liability for intent, gross negligence, injury or death, or any liability that cannot be limited under applicable consumer law.

Section 17: Indemnification
You agree to compensate and protect OralBrite, Shopify and our affiliates, staff and partners against losses, claims and reasonable legal costs that result from your breach of these Terms, your violation of the law or someone else’s rights, or your use of the Services.

Section 18: Severability
If any part of these Terms is found to be unlawful or unenforceable, that part is removed to the extent necessary, and the rest remains valid.

Section 19: Waiver and Entire Agreement
If we do not enforce a right or provision straight away, that does not mean we give it up. These Terms and the policies on our site form the entire agreement between you and us and replace any earlier versions or agreements.

Section 20: Assignment
You may not transfer or assign your rights or obligations under these Terms without our written permission. We may transfer or assign ours without consent.

Section 21: Governing Law
These Terms are governed by the laws of [the Netherlands]. Disputes are handled by the courts of [your jurisdiction]. If you are a consumer in the EU, you keep the protection of the mandatory consumer laws of your country of residence, and you may also bring a dispute to the courts there.
